U.S. files complaint under CERCLA against two NY companies
This month the U.S. initiated a CERCLA suit against IMC Eastern Corporation (“IMC”) and Island Transportation Corporation (“ITC”), to recover the cleanup costs associated with groundwater contamination at the New Cassel/Hicksville Groundwater Contamination Superfund Site. The site, located in Nassau County, NY, is approximately 6.5 square miles and includes residential, commercial and industrial areas. IMC and ITC allegedly used hazardous substances, namely VOCs, in connection with their businesses; “exposure to high levels [of VOCs]… can cause a variety of adverse human health effects, such as damage to the nervous system, liver, kidneys, and reproductive system… [are] harmful to unborn children and are considered possible carcinogens.”
